I UNDERSTAND THAT THERE ARE INHERENT RISKS INVOLVED WITH CHARTERING/SNORKELING/DIVING, ETC, Including but not limited to equipment failure, perils of the sea, acts of other participants, and adverse sea and weather conditions, and I HEREBY ASSUME SUCH RISKS.
I UNDERSTAND THAT I HAVE A DUTY TO EXERCISE REASONABLE CARE FOR MY OWN SAFETY AND I AGREE TO DO SO.
I assert that I am physically fit to ride on a boat and I will not hold the vessel At Ease and/or All American Fishing Charters LLC/Captain James Grebe or their employees, agents or other associated personnel responsible if I am injured as a result of ANY problems (medical, accidental or otherwise) which may occur while chartering the boat or otherwise participating in the trip.
I fully understand that the vessel At Ease has limited medical facilities and that in the event of illness or injury, appropriate care must be summoned by radio and treatment will be delayed until I can be transported to a proper medical facility. I agree in advance to these conditions.
All American Fishing Charters LLC/Captain James Grebe and vessel AT Ease, have made no representations to me, implied or otherwise, that they or their crew can or will perform safe rescues or render first aid. In the event I show signs of distress or call for aid, I would like assistance and will not hold the vessel At Ease or All American Fishing Charters LLC/James Grebe, their crew or passengers responsible for their actions in attempting the performance or rescue of first aid.
I agree to forever discharge and release All American Fishing Charters LLC/Captain James Grebe, vessel At Ease, its employees and agents, owners and affiliates from any and all responsibility or liability for any and all injuries or damages. I agree NOT to make a claim against or sue any of the above parties for injuries or damages whether they arise or result from any NEGLIGENCE or other liability, EVEN IN CASES OF GROSS NEGLIGENCE. I further specifically agree, on behalf of myself, my heirs and assigns, to indemnify and hold harmless the released parties for any and all causes of action arising as a consequence of any incidents which might occur as a consequence of my participation in any activities with or involving the released parties.
I acknowledge that I am aware of the coronavirus, COVID-19, and the contagious nature of the virus which is spread mainly from person-to-person contact. I am also aware that I may from time-to-time be in close proximity to others while onboard the vessel At Ease including but not limited to proximity and/or contact with Captain James Grebe. I understand that social distancing is recommended by governmental bodies and health agencies, and I acknowledge that I will attempt to comply to the best of my ability with those recommendations. By signing this agreement, I voluntarily assume the risk that I may be exposed to or infected by COVID-19 by engaging in activities on the vessel At Ease or All American Fishing Charters LLC and that such exposure or infection may result in personal injury, illness, permanent disability and death. I understand that the risk of exposure to or infection by COVID-19 on the vessel may result from the actions, omissions, or negligence of myself and others, including but not limited to other passengers onboard and employees of At Ease or All American Fishing Charters LLC/Captain James Grebe.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself or my children which may be sustained in connection with activities associated while on the vessel At Ease or during the charter trip. On my behalf, I hereby release covenant not sue, discharge and hold harmless All American Fishing Charters LLC/Captain James Grebe, vessel At Ease, its employees and agents, owners and affiliates from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of At Ease its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any activity on the vessel or during any part of the charter trip as referenced above.
I HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY IT, FROM THE DATE OF MY SIGNATURE, FOREVER INTO THE FUTURE.
